These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Kshilp Infotech Private Limited, Vachimi Studios (a business unit of Kshilp Infotech Private Limited), and Perceptifly (collectively, the "Company", "we", "us", or "our").
By accessing, registering, logging into, or otherwise using the Perceptifly application, website, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.
We reserve the right to modify these Terms at any time without prior notice. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
By using the Platform, you represent and warrant that you are at least 18 years of age, possess the legal capacity to enter into a binding agreement, and that all information you provide is accurate and complete.
Perceptifly is an AI-based simulation platform designed to analyze and simulate potential interpretations and reactions to user-provided content including text, images, and communication scenarios.
All outputs including risk scores, persona reactions, and rewrite suggestions are simulated, predictive, and probabilistic in nature. They are not factual representations, guaranteed outcomes, or professional advice of any kind. Any reliance on Platform outputs is entirely at your own risk.
You retain ownership of content you input ("User Content") and are solely responsible for its legality and appropriateness. You agree not to submit content that violates any law, is defamatory or harmful, infringes on intellectual property rights, or contains malware.
You shall not attempt to reverse engineer the Platform, use automated systems to exploit it, or use it to generate harmful or deceptive content.
Indemnification: You agree to defend, indemnify, and hold harmless Kshilp Infotech Private Limited, Vachimi Studios, and Perceptifly from any claims, damages, and expenses arising from your use or misuse of the Platform, your User Content, or your violation of these Terms.
All outputs generated by the Platform are produced by artificial intelligence systems and are simulated and probabilistic in nature. The Company makes no representations regarding the accuracy of outputs or the likelihood of real-world outcomes. All personas and simulated reactions are fictional constructs and do not represent actual individuals.
To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform, including emotional distress, relationship conflicts, reputational harm, or financial losses. The Platform is provided on an "as is" and "as available" basis.
In no event shall total liability exceed the amount paid by you for use of the Platform, or INR 100, whichever is lower.
By using the Platform, you consent to the collection and processing of text inputs, images, behavioral data, device information, and session data. Your data may be used for improving AI models, analytics, personalization, security, and marketing purposes.
You grant the Company a worldwide, perpetual, royalty-free license to use, process, analyze, and distribute your data and User Content for the purposes described herein. The Company may anonymize and aggregate your data for analytics and research without further notice.
By submitting content to the Platform, you grant Kshilp Infotech Private Limited, Vachimi Studios, and Perceptifly a non-exclusive, worldwide, perpetual, royalty-free license to use, host, store, reproduce, modify, publish, and distribute such content for operation of the Platform, improvement of AI systems, marketing, and research purposes.
Your data may be shared with affiliates, third-party service providers, analytics partners, and marketing platforms as necessary for Platform functionality and marketing. The Company may also disclose data to comply with legal obligations. While reasonable measures are taken to protect data, the Company does not guarantee absolute security.
The Platform uses cookies, web beacons, pixels, SDKs, and tracking scripts to enable functionality, analyze usage, personalize content, and support marketing. By using the Platform, you provide explicit consent to such use. You may manage cookies through your browser settings, though this may affect Platform functionality.
You agree not to use the Platform to violate any law, exploit or harm individuals, reverse engineer the Platform, use bots or scrapers, or attempt unauthorized access to any systems.
The Company reserves the right to suspend or terminate your access at any time without prior notice for violation of these Terms, suspected misuse, or legal requirements. Termination may result in loss of access to data and content.
All payments are final and non-refundable unless required by law. Credits are non-transferable, have no cash value, and may expire at the Company's discretion. The Company reserves the right to modify pricing and subscription structures at any time.
All rights in the Platform including software, algorithms, AI models, design, and branding are owned by Kshilp Infotech Private Limited. No rights are granted beyond a limited, non-transferable right to use the Platform per these Terms.
The Platform may integrate with third-party services including social media platforms, analytics providers, and advertising networks. The Company does not control these third parties and is not responsible for their performance or behavior.
Psychological & Decision-Making: Platform outputs are not substitutes for professional mental health, relationship, or life advice. Use is at your sole discretion and risk.
Experimental Technology: The Platform utilizes experimental and evolving AI technologies. Outputs may contain inaccuracies and inconsistencies. The Company disclaims all liability arising from such limitations.
Simulation vs Reality: Platform outputs do not reflect or guarantee actual human behavior, audience reactions, or real-world outcomes.
Social Outcomes: The Platform does not guarantee virality, engagement, or audience reach. Any expectation of social performance is at the user's own risk.
The Platform is provided "as is" and "as available." The Company does not guarantee uninterrupted operation and reserves the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice.
The Company shall not be liable for failure or delay in performance due to events beyond its reasonable control, including natural disasters, acts of government, war, internet failures, or technical outages.
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
These Terms constitute the entire agreement between you and the Company regarding use of the Platform and supersede all prior agreements.
